U.S. Terms and Conditions

PLEASE READ THIS DOCUMENT THOROUGHLY! THIS DOCUMENT CONTAINS IMPORTANT TERMS AND CONDITIONS FOR USE OF PEGASUS PRODUCTS.

Definition of terms:

Agreement: These terms and conditions apply to your purchase and dealings with Pegasus Audio Visual Products, Inc. in the United States

PEGASUS: PEGASUS Audio Visual Products, Inc.

Product: Your purchase of PEGASUS merchandise and/or service.

You accept and are bound to the terms of conditions of this Agreement when you purchase from PEGASUS.

I. Documents. No person(s) other than PEGASUS shall alter, supplement, or amend this Agreement using of any other document(s) unless PEGASUS and you sign and agree to in a written agreement.

II. Pricing and Availability. All pricing stands subject to change. PEGASUS reserves the sole right to adjust product and service prices at any time for any reason. All orders stand subject to product availability; therefore, PEGASUS cannot guarantee that it will be able to fill all orders.

III. Payment Terms; Orders; Quotes; and Interest. PEGASUS retains sole control over payment terms; however, unless PEGASUS agrees otherwise, customer will pay at point of sale. Customers may pay for Product with credit cards, wire transfers, checks, or other prearranged methods; however, PEGASUS under its sole discretion may require that you use an alternate method. PEGASUS retains the right to hold a shipment until PEGASUS can verify payment’s authenticity. PEGASUS reserves the sole right to cancel an order for any reason; additionally, PEGASUS is not responsible for pricing, typographical, or other errors in any PEGASUS offer, and PEGASUS reserves the right to terminate any orders resulting from such errors. Orders are not binding upon PEGASUS until PEGASUS accepts the payment terms. PEGASUS may invoice an order separately. You agree to pay interest of one and one-half percent (1 ½%) on all past-due balances. In the event of payment default, you are responsible for all costs including Product and/or service costs, court costs, filing fees, and attorney fees.

IV. Shipping Charges; Taxes; Title; and Risk of Loss. Shipping is an additional charge unless PEGASUS expressly agrees and indicates at time of sales. Loss or damage to the Product that occurs during shipping by a PEGASUS chosen courier is the responsibility of PEGASUS when reported to PEGASUS within 48 hours. Loss or damage to the Product that occurs during shipping by a courier you selected is your responsibility. PEGASUS is not liable for packages left at the recipient’s address. IF YOU FAIL TO INFORM PEGASUS ABOUT THE DAMAGED PRODUCT WITHIN 48 HOURS, YOU TAKE FULL RESPONSIBILITY OF THE PRODUCT. You must claim any tax exemption and provide documentation at time of sale. Unless otherwise stated, you are responsible for all taxes and duties associated with the orders. Shipping dates are estimates only.

** Buyer shall examine all merchandise promptly on receipt thereof. Buyer shall notify PEGASUS Audio Visual Products, Inc of all claimed shortages or damaged merchandise within forty eight (48) hours of receipt of goods. Failure to give such notice shall be deemed an acceptance of the goods as of the date of shipment.
Reversible Dry Erase Boards (large boards) Flat Panel TV Carts are shipped out by truck the shipping fee paid is to your loading docks or curb side ONLY. If your order comes to you by truck you have to open and inspect your order regardless or what the outside of the carton my look like. Large objects like Dry Erase Boards can be damaged during transit and it is your responsibility to inspect your shipment on arrival. We will replace any damaged product free of charge if it is signed for as damaged upon arrival.

V. Return Policies and Exchanges. PEGASUS does not sell on approval or provide a free trial period. PEGASUS offers a 30-day return policy on selected items with sole approval of PEGASUS. Any returns or exchanges will occur in accordance with PEGASUS’s return policy. Before you attempt to return your Product, you must contact PEGASUS directly to obtain a Return Authorization Number (RMA), which return approvals stand solely in the discretion of PEGASUS. The RMA is to accompany the return. You must return Product in its original or comparable packaging. You are RESPONSIBLE for risk of loss, and shipping and handling fees for returning or exchanging Product. PEGASUS will not accept returns for opened and/or used Product unless they are defective and you reported them as defective within 48 hours of receipt. In which case, PEGASUS will make an exchange. PEGASUS, at its sole discretion, may apply a twenty percent (20%) restocking fee to all returns. You must ship approved returned packages with a RMA with in 7 days to the designated address. If you fail to follow PEGASUS’s return or exchange instructions, PEGASUS is not responsible whatsoever for Product that is lost, damaged, modified, or otherwise processed for disposal or resale. Per the discretion of PEGASUS, you will receive a refund of the approved, return item's amount you paid; however, PEGASUS may credit partial returns less than invoice due to bundled or promotional pricing.
